Terms of Service
1. Acceptance of these terms
These Terms of Service (“Terms”) form a binding agreement between you and Alexandru Molea (“we”, “us”) regarding your use of the Continuo iOS application (“the app”, “Service”). By creating an account or signing in, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
2. Eligibility
You must be at least 16 years old to use Continuo. If you live in a jurisdiction with a higher digital-consent age, you must meet that age instead. By using the app you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. What Continuo does
Continuo helps you record daily reflections, set goals, track personal growth competencies, log mindfulness minutes, and (optionally) share specific items with a coach who is also using the app. Coaches may additionally send clients goals that appear in the client's account, and send structured feedback forms which clients complete and submit back to the coach. The app is provided “as is” and we improve it over time — features may be added, changed, or removed.
4. Your account
- You may create an account using email and password, Sign in with Apple, or Google Sign-In.
- You are responsible for keeping your credentials secure and for any activity that happens through your account.
- If you suspect unauthorized access, change your password (or revoke the social provider's access) immediately and notify us.
- You may use the app as a Client or as a Coach. The role you pick during setup determines which features are available to you.
5. Coach–client relationship
If you are a Coach using Continuo with clients, the following applies:
- You may send clients goals that appear directly in their account and are visible to both parties.
- You may send clients feedback forms containing questions of your choosing. Client responses are stored and visible to you via the app.
- You are solely responsible for using feedback data responsibly, keeping it confidential, and complying with the laws and professional regulations of your jurisdiction — including (where applicable) confidentiality, data protection, and consumer-protection rules.
- You must not use feedback data to harm, pressure, or discriminate against clients.
6. Wellness disclaimer
The reflections, prompts, mindfulness timer, and competency metrics offered by Continuo are intended for general personal-growth purposes only. They are not medical advice, diagnosis, treatment, psychotherapy, or a substitute for professional mental-health care. If you are experiencing distress or a mental-health crisis, please contact a qualified professional or emergency services in your country.
7. Your content
Everything you write in the app (reflections, goals, conclusions, assignments, notes, mindfulness logs, feedback responses) belongs to you. You grant us a worldwide, royalty-free, non-exclusive license only to host, store, transmit, and display your content as needed to run the app, sync it across your devices, and share specific items with a coach you've explicitly connected to.
When a coach sends you a goal or a feedback form, the content of that goal or form is created by the coach but stored in your account. Your responses to feedback forms are your content and are shared back with the coach who sent the form. We do not use any content to train AI models, to advertise to you, or for any purpose unrelated to operating the Service.
8. Acceptable use
You agree not to:
- Use the app for any unlawful purpose or in violation of applicable laws.
- Harass, threaten, or harm other users (including clients you coach or coaches you work with).
- Upload content that is illegal, defamatory, hateful, sexually explicit, or that infringes another person's rights.
- Attempt to access accounts other than your own, scrape the Service, or interfere with its security.
- Reverse engineer, decompile, or attempt to extract the source code, except where permitted by law.
- Use the app to provide regulated services (medical, psychotherapy, financial advice) without holding the appropriate professional credentials.
We reserve the right to suspend or terminate accounts that violate these rules.
9. Third-party services
Continuo relies on third-party services to operate, listed in our Privacy Policy (Firebase by Google, Apple Sign In, Google Sign-In, Apple HealthKit). Use of these services is also governed by their respective terms. We are not responsible for issues caused by outages or changes in those services.
10. Subscriptions and payments
Continuo is currently free to use. If we introduce paid features in the future, prices, billing terms, and refund policies will be presented clearly before purchase and handled through Apple's App Store. Apple's Media Services Terms apply to all in-app purchases.
11. Termination
You can delete your account at any time from Profile → Delete account. Doing so removes your personal data — see our Data Deletion Instructions for details.
We may suspend or terminate your access if you breach these Terms, if the Service is being misused, or if continued operation becomes legally or technically infeasible. Where possible we will give reasonable notice before doing so.
12. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that the app will be uninterrupted, error-free, or that any data you store with us will always be available.
13. Limitation of liability
To the maximum extent permitted by law, neither Alexandru Molea nor any contributor to Continuo shall be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service. Our total cumulative liability for any claim arising out of these Terms is limited to the greater of: (a) the amount you paid us for the Service in the 12 months before the claim arose (likely zero, as the app is free), or (b) €50.
This limitation does not apply to liability that cannot be excluded by mandatory law (for example, liability for gross negligence or willful misconduct under EU consumer-protection laws).
14. Indemnification
You agree to indemnify and hold us harmless from any claim or demand (including reasonable legal fees) brought by a third party arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of another party.
15. Governing law and disputes
These Terms are governed by the laws of Romania, without regard to its conflict-of-laws principles. Any dispute that cannot be resolved informally shall be brought before the competent courts of Bucharest, Romania.
If you are a consumer residing in the European Union, you also have the right to use the EU Online Dispute Resolution platform. Nothing in these Terms limits your rights as a consumer under mandatory local law.
16. Changes to these Terms
We may update these Terms as the app evolves. When we make material changes we will notify you in-app or by updating the “Effective” date at the top of this page. Continued use of the Service after the change means you accept the updated Terms.
17. Miscellaneous
- Entire agreement: these Terms together with the Privacy Policy constitute the entire agreement between you and us regarding the Service.
- Severability: if any provision is found unenforceable, the rest remains in effect.
- No waiver: our failure to enforce a right does not waive that right.
- Assignment: you may not assign your rights under these Terms without our consent; we may assign them as part of a business transfer.
